Default No police report filed, is there still something I can do?

I got rear ended today while sitting at a stop sign. I was a bit shaken up and at the time, I only seen a minor scratch. When the police got there he said it wouldn't make sense to do a police report since the marks on the car were minor and insurance probably wouldn't cover it. When I got home my husband noticed the bumper is cracked. Also I started having neck and back pains once I layed down. I have the other drivers name insurance company and tag number, is there still something i could do eventhough i didnt get a report.

A police report is not always necessary in order to pursue a claim against the other driver in an accident.

The reason that a police report is important is that it provides an objective description of the accident based upon the accounts given by all drivers and witnesses. Without a police report, the insurance company will have to proceed based on your own version of the events, along with that of the other driver, and figure out just what happened and who is at fault. It will end up being he said/she said, which can be tricky, especially when there are injuries involved.
