Default Insurance wants to total my car instead of paying for damages.

Albuquerque, New Mexico. I need to know if i have a case against an insurance company. The driver that hit me had insurance and he put more damage to my car than its worth. Liberty mutual wants to total my car but i want it fixed and neither of us were injured. Can i sue them for damages?

I wish to inform you that in circumstances when the repair of damage done to car are more then value of car then insurance company can pay value of car. Insurance company is required to compensate for the loss. In this regard when repair expense amount exceed value of car then actual loss may be limited to value of car because you may have same new vehicle in the cost.

You always have the option (depending on state laws) to buy back your car as a salvage title. Check with your car insurance company if you can exercise that option.

Yeah obviously you should sue against the other party as he is responsible for the damage that has been caused to the car, one cannot just finish it up on the car, you take the guidance of a well known lawyer and the rest he'll do it...
