Angry Can I claim for loss of use?

To cut a very long story short, I had an accident which was my fault in Feb. I was fully comp.

The insurance co had my car picked up, sent to the garage and it was returned 3 weeks later. Unbeknown to me, when returned, it was on the back on a low loader as they couldn't start it!?!

I came home and obviously also couldn't start it and phoned my insurance company to report the fault. They claimed on several occasions that it had nothing to do with them as it was not related to the accident.

I fought my case for several weeks desperate to get my car back so eventually gave up. I called my own engineer out after 12 weeks without the car and was told that they didn't replace the battery terminal correctly after fitting new panels and it therefore wouldn't start.

I have complained to the insurance co. and they have agreed that it was ridiculous and should have been dealt with much earlier, apologising and saying that I will be compensated.

They sent me a cheque in the post for

Can I claim for Loss of Use for 12 the weeks? If so, is there a normal daily amount to claim?

Any help appreciated.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no lawyer...you could try to collect all of the costs and damages that you suffered due to their behavior...
