hit by drunk driver

I was rear-ended by a possible drunk driver while sitting at a red light, he never even used the brake at all.

the individual may have been drunk, has a suspended license, and probably no insurance.

my small sedan is so old and so totaled that I'm sure ill receive no money to fix it.

his SUV shows no damage whatsoever. can I sue him for possession of his vehicle?
