Confused Car accident claim: Reimbursement for car rental

Hello,

I was involved in a car accident more than a year ago. The other driver did not stop at a stop light and hit my car. Initially, the other driver’s insurance company offered to pay me 90% of the damages. However, I asked my insurance company to intervene, and a few days ago, they were able to successfully recover 100% of the costs from the other driver’s insurance company via arbitration. In other words, it has been established that the accident was 100% the fault of the other driver.

My question is: Am I eligible for reimbursement of rental car expenses while my car is being fixed? Because I do not carry the coverage on my insurance, my insurance company did not take up the issue with the other driver’s insurance company. My insurance company suggested that I contact the other driver’s insurance company on my own with a request to cover the rental car expenses.

Does anyone have any experience or insights on whether the other driver’s insurance company is required to or is likely to cover the expense?

Any suggestions and tips on how to approach the other insurance carrier would also be very helpful.

Did you sign a release in association with the prior settlement of the damage claim? If not, do as suggested - contact the at-fault party's insurance and see what they say. If so, you need to read the release and see if it prevents you from making the additional claim (although the worst they'll do if you call and ask is say.
