If one had an auto accident in Illinois and the Plantiff and the defendant were both from the state of MO, could the plaintiff bring forth the case in State Court in MO or would he have to bring the case to IL or Federal District Court. The case amount would be over $75 K but I do not think there would be diversity of citizenship. So my question is where could the plaintiff file his complaint? In state court in MO, state court in IL or District Court in MO or IL? Who would have jurisdiction over the case?
Thanks, rmscomp@tampabay.rr.com |

The court should let the suit be filed where the defendant is as well.

One does have to wonder how someone living in Florida comes to be involved in an accident between two Missouri residents who just happen to be in Illinois at the same time at the same place.
And of course some people have a problem with fraudulent insurance claims, somewhat less than accurate tax returns and other assorted get rich quick schemes. Apparently they don't learn from their own history. |
