Default Fail to yield ticket/hazard action Michigan

I was wondering if a police report having a hazard action and receiving a ticket for failing to yield is one in the same. I received a ticket when I was parked and got out of my car and another car hit my door causing $2,000 worth of damage. I took the ticket to court and they found me not responsible for Failing to yield ticket and I was wondering if the Hazard action of failing to yield is a moving violation? The lady hit my car and bumped my back end into the road about 2ft maybe but there is about 3 lanes for traffic to get in and out of the township parking lot is not marked nor is the road defined. She moved her vehicle before the cop came and he found me at fault eventhough she told me she was not paying attention, talking on her cell phone and didn't even no that she hit my door and kept driving. She pulled her vehicle backwards until the two cars seperated. The cop didn't get any statements just found me at fault saying I was parked in the road but I wasn't parked in the roadway but on the side of it. Insurance has refused to pay and She also broke the hinge pin. Speed limit was 25miles perhour and the cop didn't even know that it was a road. over the last 10 years people have parked on the side of that road which looks like it is part of the parking lot. Nothing is defined. I looked out my window and i don't know where she came from but she hit me and wasn't paying attention and got 0 for hazard being not at fault. How can that be. I live in Michigan.

Generally, a hazard action is of less severity than a true failure to yield. I am not entirely sure if you lost in criminal or civil (i.e. small claims) Court, but either way it sounds like you have a predicament on your hands concerning both your driving record and the insurance coverage. My best suggestion would be to speak with a licensed Michigan lawyer. If you will go to the WLD main page, you could get a referral for one in your area.
