NYC - I came out to discover my windshield has been shattered by a golf ball from the coutry club by my apt. My car is parked on a public street. I filed a police report, have pics, the actual ball and there's an impression of the golf ball's dimples in my weatherstriping (hit where glass meets). There's also no netting/fencing where my apt is. The club should have some insur. to cover such things. Are they liable? or is it the ol' "golfer did it, not our problem"?

Unfortunately, it's not the courses responsibility nor is it the golfer's responsibility. This has been tested in court many times and the result is "the golfer hitting the ball doesn't know where the ball is going", so there is no intent. If the golfer was standing on the hood of your car and broke the windshield, it becomes another issue of intent. As far as insurance coverage, I'm assuming you are covered so I suppose you should file a claim with your insurance company. If the deductible is too high you may end up eating the cost of the repair.

I did sue one golfer in small claims and won. Judge said the golfer was purposely wreckless.

If there was intent to damage property or if somebody was negligent and there were witnesses willing to speak, you could have a case in small claims court. Just hope the judge you get isn't a golfer :-)

If your car gets dinged then we will help you to find the golfer responsible but we bear no responsibility for errant golf shots.

what if the golf ball was from a driving range where the net isnt high enough to stop the balls and many times it has flown over then net and hit things, then the onwers o the ramnge know there is a problem yet havnt limited the damage.
