Canadians in auto accident in US
Hi, my boyfriend is Canadian and was in a fenderbender with another Canadian in Michigan, US. The woman he rearended was adamant about not claiming this on her insurance because she has been in so many car accidents that it would push her rates through the roof. They made a police report in the US, but the woman said that it was her fault for slamming on the breaks at a yellow light.
Now, about 6 months later, this woman is going through a lawyer to get compensation for a "neck pain" that she supposedly received from this accident. My boyfriend has no personal insurance because that's covered in Canada. His auto insurance would not cover this either because it's a medical injury. Since she was so set on not making a report about this, is he obligated to pay her anything? As far as Canada is concerned, this accident never took place because the correct reports were never submitted by her. What should we do? Thank you so much! |

He need not pay frankly...let the lawyer file in court if he wishes and if you have any applicable insurer they will talk with him. If you don't have any coverage the lawyer will most likely not sue.

Thanks for your response. We are compiling a letter that is very straightforward, explaining exactly what happened and stating that there is no coverage that would compensate what they are asking. Basically, we are saying no...because saying nothing is as good as saying yes. We HAVE to say no in a very controlled gentle way.
Should we be detailed in the letter or simply state that there is no coverage to cover the compensation that they are requesting? Thank you again. I feel like this is looming over us, but that hopefully it will not be a huge issue. Thank you, |
