Hi, I've never been involved in a car accident before, and I need some advice on what to do next. Here's the deal:
1. Accident: I was driving on a through street when another driver failed to stop at their stop sign, and entered the intersection I was passing through, causing me to hit them. The other drivers car was clearly totalled, my car looked totalled. All parties went to the hospital. I am not sure the extent of the other drivers possible injuries, I was 4 mos pregnant, and although things looked ok on the ER ultrasound, I am extremely worried that this may have harmed my baby. I recieved the police report a few days ago, which puts the other driver at fault for the accident. 2. Vehicle: My insurance company quickly attended to my rental car needs and began evaluating my vehicle. I was told they were going to "try to fix it" and have not heard back from them in 3 weeks!! I was told there was major frame damage among other things. So basically, although my insurance is keen to fix the vehicle rather than 'total' it...I do not feel safe driving this car any longer. I'd like to know what my options are in so far as putting in a claim against the other driver. A. Can I ask the other driver's insurance for the cost of replacing the car? Then pay my insurance their cost of repairs and keep the difference to replace this vehicle? B. What would I ask for? The suggested retail value of that model/make/year? Or the cost of buying that same vehicle new this year (2009 model)? C. If I cant ask for the full cost of the vehicle, how can I get an estimate for the depreciated value without paying someone up front? I can't afford an expensive estimate...just paying my deductable to get the vehicle back will break me financially. I really dont know what to do. I called 3 lawyers none of whom seemed interested in my case...mainly I think because their specialities were injuries. I dont want to put my newborn baby into this car after all of this damage and I have no idea how to approximate how much I should ask for from the other drivers insurance. Please help! |

They will fix it or give you the blue book value.
You can sell it if you don't want to drive it after they fix it. |
