attorney playing with our heads?

In 2003, my fiance got hit by a tractor trailor truck and had a cop plus another guy as a witness to the whole thing, he was diagonosed with several herniated discs which led to neck surgery and took him off work for almost 2 yrs..still to this day, the pain will never subside...but pain pills led to the addiction to herion and now he has been in and out of prison..he cleaned up his act, but violated probation so he is back in there and the attorney on his case discussed the lawsuit to us before my fiance was in jail and asked if we wanted to settle because jury could possible ruin alot because if one word slipped about criminal background, we could walk out empty handed so we decided to settle out...well 2 months later is when my fiance was arressted and his attorney says in one breath, he can get the money now but we need my bf consent and in the other breath says he can't get nothing unless he is out of jail first...my fiances mom wants poiwer of attorney over this so our debts on the outside can be handled but his attorney said we can't do that..were not allowed, he recently went up to visit my fiance and told him that he needs to get out of jail to handle lawsuit because he don't want him seeing the "mediator" in blue jailsuit, and that it will take another 2 years for his money, i have to be blunt, what the hell is this man up to doing? i have talked to other attorneys who say my bf should of had this money a long time ago..is this attorney toying with us?
