Statute of Limitations On Uninsured Motorist Claim

I was injured in an auto accident in May 2006. It was the other driver's fault. We later found out he did not have insurance. I had full coverage on my car. I have had horrible neck pain and headaches since then. I did not file a claim with the insurance company because my fiance was worried it would make our rates go up. I can't take it anymore. The pain and headaches are horrible.

What can I do now and am I out of the statutes of limitations in Texas?

I went to a doctor last year for this injury but he really isn't helping. I am going to another doctor Tuesday. I received a letter from my insurance company a couple of weeks ago stating that in May they will no longer pay for any medical treatment.

What should my next step be? I want to have Xrays and possibly an MRI. Should I retain a lawyer and does the insurance company have a right not to pay because I was under the impression that the statutues do not run out for 4 years?
