I was making a left turn, the other individual was making a left turn from the opposite side of the road. We both started to turn at the same time. I saw him and stopped, he wasn't paying attention and continued to accelerate. He ran into me. A large portion of the front of my car is damage, including the AC radiator, engine radiator, frame of the engine bay, engine bushing, and the entire bumper assembly. The police at the time said no one was at fault, and that we should pay for our car's damages individually. However if the other driver was paying attention and stopped like i did, the accident would not have happened. What should I do?
We both had stop signs, no traffic lights.

If he hit you and you were stopped then he is normally liable.
You can take him to small claims court and sue no matter what the police officer had to say. And/or your insurer can handle it for you. |

You can if they will collect for you. Or you can just sue the other persons in small claims.

The police report states:
"Driver of V1 [me] stated he was making a left turn onto route 30 from dill avenue when he collided with V2 [him] just prior to the double yellow line. Driver of V2 stated he was making a left turn out of luciens manor onto route 30 when he came into contact with V1. No reported injuries at the scene. *blocks 118A 119A indicate both drivers were innattentive." It does not clearly say I was at a complete stop when he hit me... Would I have a chance in a small claims court? Or should I just pay for this out-of-pocket ? |

You should just go on your parents policy as that will be cheapest. Their policy should have covered your accident since insurance follows the vehicle. You can pretty much guarantee that you will be paying a ridiculous amount of money each month for insurance. Check with an independent agent in your area.
