My daughter was driving my car with my permission, even though she is excluded on my insurance. She was involved in an accident and was found to be at fault. Now we are both being sued. The Plaintiff's petition states that I was the driver and she was the owner of the car, which is backwards. How do I respond to this Civil Citation?

See http://www.worldlawdirect.com/article/926/Answering_a_complaint.html
You should answer the complaint generally (see the above) but if the amount at issue is large, counsel should be hired. You may want to consult closely with your insurer to make sure that she is not included--or perhaps some kind of argument could be made that she is included. Kind regards. Susan Kinney |
