Confused Half of my lowest estimate

Insurance company for a taxi is offering to pay half of my lowest estimate for a taxi that hit my parked vehicle. The person in claims says the driver was fighting for his life when someone was robbing him at gun point at the time of the accident and that the law doesnt hold the driver liable. I think they should pay the full amount but i am not sure if there is a law that protects insurance companys in this type of situation. I need to be sure before i go to small claims. The accident occured in NJ.

There is no law that requires that. You can sue them in court.
