auto insurance rights

My boyfriend was in an accident about a month ago, he was injured and the person who was at fault her insurance is still going through the determination process. he has a lawyer to represent him, but they don't represent me. My insurance gave me an offer on the amount they will pay as the payoff on my totaled car, but I still owe $6,000 on the loan, and I want reimbursment for 2 car payments $800.00, and insurance payments $156.00, car rental forone day $40.00. do I have the right to send a demand letter asking them to pay? can I sue her? Also I have a complaint against my insurance do I the right to sue them too?

You can sue her and your insurer both in small claims if you are not able to get adequately compensated in your opinion.
