Confused I Need Help Determining Fault in Auto Accident

I was on the East side of a traffic light backing out from a slanted parking spot on the right side of the road going to continue East. As I was backing out I visually noticed the traffic light changing from yellow to red, which means I was already moving when a woman in a truck waited for her light to turn green turned left and tried to squeeze herself between my vehicle and the yellow line but missed and side swiped me. I was completely stopped in the road switching from reverse to drive when the lady hit me. her initial contact was mostly on my driver side rear quarter pannel also the bumper. And after she had hit me she continued to press the gas which moved my small car farther and farther to the right. The police finally arrived after around 15 minutes and said the accident would be my fault because "I pulled into moving traffic and failed to yield right of way." Said it is no matter that I was completely stopped about to drive forward and be out of the way. She also wrote in the police report that I hit her when I was not moving, It literally states those words. The police department will not help me with this issue at all, wrote up the report completely false and just laughs at me for trying to get it changed. Even when I have a witness that was at the other red light that says he saw me completely stopped before the truck came out of the turn. And she said to me (not the officer) that she didn't see me; which I find crazy seeing that there were no vehicles stopped on my side of the red light and I was the first vehicle parked on my side and no vehicles parked on the other side. She had 50-70 feet to see me and never did. What should I do? Who should really be at fault here?

Take that explanation and any and all evidence to court and you will likely prevail.

whoa! that woman is such a liar...

I suggest find other witnesses that will testify that the accident was'nt your fault... As i thought this is the only way because the police is in favor for the woman and not you...

I think you need to seek legal help. An attorney can help you in understanding your situation better. You must also exchange information with the other driver—your name and driver’s license number, the vehicle identification number of the car you are driving, the name and address of the car’s owner.
