Need Legal Advice Please Help!!

My name is Christina. I am a junior at East Tennessee State University. I was in an accident on November 3, 2008. I was rear-ended when pulling into my driveway at the house that I currently am renting. The driveway is off of a four lane highway and I share it with the neighbors. There was a car that was parked in the driveway which obstructed my path to pull all the way in. I was partially in the driveway with no where to go when I was rear-ended by the car going down the highway. The boy in the car that hit me is 16 years old. The boy was probably going about 40 mph when he hit me and crushed my car. My car is totaled. The boy is claiming that I was backing out of the driveway, which I was never doing. The police wrote the report up that I was at fault for the accident and gave me a ticket for improper backing, which I was never doing. My insurance company even sent out an engineering company to look at my car to determine if the car was in reverse and have determined that I was not at fault. My insurance company has investigated the accident and has dropped the claim of paying the other guys damages. The accident was not my fault by any means. .

I was in a lot of pain from the impact of the accident, but was wearing my seat-belt so no major injuries. I have been going to a chiropractor for my minor injuries and pain. However, I have no medical insurance. I have never been in an accident before, never been pulled over, nor have I have ever had a ticket. I am 23 years old and have been driving for 8 years. I just got my car paid off and put into my name, as well as liability insurance. I just moved to this area in august. I have no family around this area to help. All of my family lives 3 hours away. I have no means of transportation. I’ve had to bum rides just to get to class every day, which in some cases I have not been able to go. I was in the process of getting a job here in this area but now I have no way to get around.

Like I said before, I have never been in an accident before this and I don’t really know what to do. I will be going to court over the ticket on December 17. I do have the neighbors as witnesses of the accident. I don’t really like the thoughts of suing but I am in a situation here that I just don’t know what to do. I need help!
