Question Rear ended

I was rear ended while at a complete stop by a man that I could tell was drunk and whom never hit the brakes probably going 20-30mph, he decided to pretend to pull over and then leave the scene for obvious reasons, I followed him and called 911, I gave dispatch his plate # and dispatcher told me to stop following him and get off the next exit ( he has priors and a DUI less than a year ago ) , the officers met with me and took the report, the next day they went to his house and arrested him.
The damage to my new big vehicle was not nearly as bad as I thought it could have been, just a replaced bumper, however both myself and passenger are injured, I've missed some work and have not been able to get back to my normal routines, I've been to the doctors and the medicines given have not helped, and I recently went back for x-rays due to the pain and discomfort - have not received results yet of x-rays. My passenger had really bad whiplash and is still having issues anytime the head makes and sudden or fast movements, then she's back to square one with the stiffness and pain again.
The guy has a prior hit and run, a DUI less than a year ago, he is licensed has insurance ext, my concern is that we even though the damage to my vehicle was not severe, had I been in a small car it would have been a different story of course, do I have a leg to stand on in regards to getting a lawyer and going after this guy if my doctor says that there are going to be long term repercussions do to the accident. I can't afford to take time off work for physical therapy and appointments so already this is becoming a huge strain on me.

If I were you, Id find a really good personal injury lawyer to help you pursue your claims in court. As you have said, the thing has really taken its toll on you. Try their free case evaluation online if you don't have much time. From the looks of it, you can recover proper compensation set forth in the law.
