Default Can i Sue

About 2 weeks ago I got hit by a drunk driver in my girlfriends 1990
Chrysler Lebaron. Not only did he hit me but hit someone else before me then
hit a telephone pole. His insurance company is saying her car is totaled
because her car is only worth around 900 bucks and the damages are over
1000. So she is only going to get either 900 bucks or the cost of her car
minus the damages. This doesnt seem right because her car was definately
going to get her a few more years and now shes basically screwed out of a
car because someone drunk hit her even tho i was driving it. Is there any
way i can sue him to get more money for the car. It just doesnt seem right
that a drunk driver who hits 2 ppl and a telephone pole can ruin someone
like this.

They MUST repair the car or offer you the equivalent value necessary to repair the car for continued use.

But, before you consider the lawsuit path, you may want to try ' shopping around. ' Lawsuits take resources that you may not enjoy yielding, specifically time and money. Believe it or not, you may find something better than what you had before the drunkard crashed your party.

I've bought two cars in my life time for only $1,000 that were in good/fair shape with over 100,000 miles on them. They both lasted 3 years on me before the repairs were too expensive to resume paying for fix-ups.

Some places to look:
- Friends and Family
- Frontlawns and roadsides
- Newspapers
- Television/Radio ads ( though be CAREFUL on this one! Many of these ' mega deals ' are just meatsacks trying to sell you lemons and overpriced garbage )
- Towing businesses
- Auctions

With the economic trends being shoved deep into the ground, you may even have the best opportunity out of anyone else who's participated in car shopping activities during this new millennium.
