Default Redhead on a Yamaha

My daughter test drove a used motorcycle for sale by another individual in a parking lot in California. Brakes grabbed and she fell scraping up the already scraped bike and herself. She needed a doctor's attention. Later she settled with the owner by paying $450. Owner now files a small claims action seeking an additional $3756 for damage to motorcycle and alleging an oral contract to buy. (Owner was offering for sale at $2500)

Our insurance excludes motorcycles. Owner was uninsured. Should we countersue for injuries?

When one lets a vehicle be used for a test drive, that owner's insurance needs to cover that.

She is not responsible when testing a vehicle for an accident that was not her fault.
