I was served papers today regarding an accident I was in just about two years ago. I was driving my four wheeler on a road with my daughter on the back. A motorcycle came out to pass the car behind me and myself, but lost control and crashed into the side of the four wheeler. Although to me he was at fault, I did not have insurance for the four wheeler (which I was unaware that I needed at the time), so the police officer on the scene laid blame on me. There were no charges filed against either party. It will be two years ago next week that this accident happened but I am getting served just under the wire.
Is this not obvious that the guy needs money???? And just because I didn't have the insurance, does it give the guy the right to drive wrecklessly and sue ME for compensation??? |

Ask a lawyer in your state regarding the statute of limitations of your accident involvement.

You can counterclaim and sue him!
If he was at fault crashing into you you may still be able to collect. Have an insurance lawyer review with you in detail. |

The law on statute of limitation varies from different states, you may check your state's law on this subject. However, it is for your advantage if you hire an attorney, they can provide you an extensive discussion on this issue.
