My daughter & friend were in a drunk driving accident

My 16 year old daughter left to spend the night with her 18 year old friend last week after calling her mom and getting the OK. I received a phone call from my daughter's friend who evidently had been with them. He told me they were all in a car accident and a lot of damage had been done to 3 properties. He said they had been drinking. He said he fled the scene because he can't get in trouble. When I arrived at the scene of the accident, a friend of the 18 year old was telling me that my 16 year old daughter had grabbed the steering wheel and caused the accident. My daughter was in the police car and was very drunk. The driver was taken to a near-by hospital and was arrested for DUI/drugs. When I picked my daughter up from the police department she didn't remember a thing that happened. The next day, I received a phone call from the other girl's mother saying that their insurance does not want to pay for the damage and will be investigating the accident, and that my homeowners insurance can pay for this because it is my daughter's fault. The 18 year old is the one who brought the fifth of vodka into the car and gave it to my daughter. Who is to blame in this situation? Would it be joint & several restitution? Is the backseat passenger who fled the scene responsible at all? I asked him 3 times if my daughter grabbed the steering wheel and he said he was lighting a cigarette and didn't see anything. What can I do about this, I have no money to get an attorney. I am distraught.

Yes it seems it may all be investigated and then fault can be determined. It may be that the fault is apportioned among them all or it may be that each is liable.

Your insurer should also discuss this with you.
Has any final police report been issued?

hmm, I think so too that the fault might be shared. He was DUI but if anybody confirms that she put her hand on the steering wheel, she might get into troubles.

Hi, thanks for answering me. It took awhile but now I have a copy of the police report. The driver states that my daughter grabbed the wheel in the first part of the report. She admits to not being able to take her foot off of the accelerator and hit the break when she was crashing the vehicle. She admits in the report to having two mixed drinks when in actuality, she was drinking the vodka straight and chasing it with pink lemonade. The police officer is charging the driver with DUI and wrote that the wrongful turn is also the drivers fault. It is all being forwarded to the DA's office. I guess I will just have to wait. I haven't heard from anyone except the drivers' mother when she called and threatened me. There is another factor in this case, the driver had stopped at a well-known resort where her friend works and that is where she got the vodka, what about this friend, would she be responsible at all?

you wrote the police officer is charging the driverDUI and that the wrongful turn is also the drivers fault.If its true no liability can be fastened upon your daughter and the said friend.It may be that the fault apportioned upon driver only.Its my opinion.Thanks.

I had seen a lot of incidents many times. Instead of the government passed a rule that those who have a drink while driving should be severely punished, but most of the teens are not caring this and they are facing many accidental risks.

Hi think you daughter and her friends should think themselves lucky they are still alive and dont have brain damage what the hell where they thinking and what sort of mother are you letting her out to go drinking and stuff if she was driving thats whats wrong with the world today i think it would be alot worse if they killed someone cause of their carless action maybe a day in a jail cell or in the troumer centre in the hospital should wake her up.

go to a hospital and knock sence into her show her what could happen if she does this if they caused they accident they may get charged. SHAME ON YOU U SHOULD PAY.
