Confused Insurance company summoning??

Hi all

My fiance was involved in a car accident about two weeks ago. Now, we're both clueless when it comes to all this legal jazz and we are also stuck and frustrated, not knowing what to do.

She opened a case and all that and she even has a witness who saw the accident happening. The man who skipped a red traffic light, drove into her from the opposite direction, as she turned out of the intersection (she was turning as the traffic light jumped from orange to red and he came skidding over his side of the red light directly into her).

Now, I myself do not know who would be to blame, but I'm pretty sure it was not her fault. A witness (who also helped her out of her car) did not give his statement, he only gave his number to her as well as the police officials who arrived to write out the report.

My fiance does not have a lawyer (she's turning 21) and neither does she have insurance. (she only bought her car about a month ago)

Now here comes the dilemma: After almost spending $500 in phone calls to the man who caused the accident's insurance brokers, they finally said to her that they will refuse to pay a single cent and that she will be summoned for the damages.

What can we do? What should we do?
She's petrified and just as confused as what I am.

Can anyone give advice?

It would really be appreciated.

Did the police come? Was any ticket given?

She can easily sue in small claims if it was not her fault.

Yes she has a case number and the traffic officer said that he will get it reported to the police department.

Apparently the latest is that a case was never made. This is SOUTH AFRICA, this country is a joke.

Now my fiance sits with a damaged car, a summoning, no lawyer and an insurance company from the accident causer's side that refuses to pay a cent, even though it was entirely his fault!
