Default PI mediation in Oregon?

I was knocked out by a rear-end collision on January 2007--the truck mashed my little Mazda into two cars in front of us, all of us stopped at a light.

Before being hit, I had been recovering from some depression related to loss of job and a parent and have been mostly at home since the accident--one and a half years ago, so I don't have much income for the two years prior to the accident.

I had a $25,000 PIFF that got absorbed in 6 months by acupunture, PT and x-rays. When it ran out, I quit going to the doctor. I was afraid I would get sneak bills at some point (this just started)

I'm frightened of lawyers.

But I look good and speak articulately. I could go to a mediation with a power point presentation or an edited video and score points. Only...

1) I don't know how to iunitiate contact with my insurance company. They quit calling regularly about six months ago. Are they waiting until I lose my opportunity? Their representative told me I had two years.

2. What points do I make if I go into mediation. I was knocked out, air bags saved me and pictures of totalled car are appalling. I limped for months and have a ton of arthritis as a result, but I was treating knees and back with acupunture before accident. My chiropractor/acupunture doctor has worked with me for ten years and has stated that my accident has caused permanent injury. My eye doctor has recommended cataract surgery (scheduled for April 1st) because (she thinks, but the surgeon will not confirm) the accident caused the rapid decline in my vision.

It is certainly possible you have a very good case based on what you say here; you really should take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you...
