I am thinking of selling some property owner financed and wonder what rights I have if the buyer uses the property for illegal activities without my knowlege.
It is scenic private rural property with several mobile homes on it that could be a family retreat for someone or for someone else it could be a place to try to grow pot or have a meth house. If the property gets seized by the state for being used in criminal activities is my mortgage lien on the property given priority in the process or is it irrelevant and the state takes the property and I get left holding the bag? Anyone know? |

You would get it back unless they can show that you knew or should have known. But you don't want to even get near that kind of problem so inspect regularly and rent to well-qualified folks!

Actually the question was based on selling the property, owner financed, not renting it.
But I assume my property rights of the mortgage lien would prevail in a criminal forfeitrue case too. Any more imput would be appreciated. |
