I am filing a Warranty Deed because my husband, who has left, has agreed to give me our home. On the Warranty Deed- Statutory Form it asks the question "The property is free from encumbrances, except:"
We have a Equity Line of credit against the home and a mortgage still owed on the home. Do I need to put that information on the form or do I just say "none". Also by filing this form will this secure the home in my name? |

Yes you would list it,
But you should have a lawyer or title company check this over when you are done, Best to avoid any big problem with such an important asset. |
