Listing Disputes
I am a NON Maryland resident and have listed my Maryland home for sale The Sellers Estimated Cost made no mention of the Maryland non resident sales tax (even though this is itemized on the contract). The listing agent knew that I did not live in the state of Maryland.
This tax is 6% of the principal paid off, which in my case is 100% on a 250,000$ home. So selling the house will net 12,500$ less than what the agent estimated on the Sellers Estimated Costs worksheet which we both signed (the worksheet DOES include a line for the Non Resident Maryland Tax). Does this omission in any way constitute breach of good estimate or am I the seller liable/legally responsible for knowing this information (which I did not) at the time signing the listing agreement? I would really like to get out of this agreement...is this right, wrong or in a gray area? |

ps,
When I wrote "listed/itemized in the contract", I mean it has a designated line in the Estimated Sellers Costs which both the seller and the agent sign. |
