I purchased my newly constructed house on 3/31/06 and provided the builder with a list of problems that needed to be corrected approximately 5 weeks later. The builder has jerry-rigged two of the problems (instead of actually fixing the problem), and has not addressed the remaining 10, or so, at all. We have gone back and forth several times. Once I told him that if he didn't finish by the end of the month I would pay to have the work done and give him the bill. He said, in a threatening tone, "don't you ever talk to me that way again!" I'm tired of living in a partially finished house and always having to fight with the builder about getting him to fix things. What do I do?

PS I have already obtained estimates for most of the more major repairs, but I have not given them to the builder. I don't know how I can prove that the builder ever received my list--it would just be my word against his. Can I take him to court before I pay to have the work done so that if I don't win I don't have to eat the cost myself? How should I approach this, just tell him that if he doesn't make the repairs I'll take him to court, or is there a better way? I've never done this before.

Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to his behavior... You may also report him to your state attorney general's office.

How do I start the process? Can I take him to court before I pay for the repairs so I don't wind up stuck with a bill? If I can't prove that he received the list, what kind of chance do I have?

You could, and cite breach of contract and whatever damages you have to cover it and fix it etc.
