I recently signed a purchase and sale agreement for a parcel of land listed as 25 acres with at least 400 feet ocean frontage. The property was to be surveyed at the seller's expense, as he was splitting a larger area.
Despite being told by the surveyor that a 400 feet frontage would yield more than 25 acres, he told him to go ahead and measure 25 acres and ignore the width clause in the contract. This yielded a frontage of 338 feet. I have demanded that he honour the terms of the signed Agreement but he refuses to do so. What is my position and what options are available? I do not consider breaking the contract to be a valid option. Your advice would be greatly appreciated. |

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered --
