Default should I get an attorney

Please Please help me I am at wits end and ready to jump in front of a truck(hopefully that won't be necessary!) 3 months ago my hubby and I decided to sell our home and use some of our equity to pay off some debt and put in the bank, We went to our financial institution and asked about the process as we have never sold and bought a huse before. Our representative said we would just port the mortgage over to the new house. We found a house that we wanted and put in an offer. It was exactly the same as our current mortgage so we were not asking for any more money or anything. That was our goal. So we had a conditional offer in on the new home which we firmed up on. We made another arrangement to meet at the bank to find out what we do next and she said once my house sells bring in the papers and we will get it all going. So we have closing dates on my house and the house we are buying. So we went back to the bank and they said they would put in the morgage fo approval . My husband and I said oh we have to go through a pre approval again(We just redone our mortgage in Oct 2006) she said yes.We asked her why she did not do this at the beginning before we put any offers in she responded with she did not think that we needed to go through this process. So now it turns out that we are not able to be approved on the mortgage of the home that we have already purchased and signed a contract and our house has sold. The bank has spproved our mortgage but the mortgage insurance company will not . Everything we done was done in the process of the bank we dealt with. They totally misguided us and I feel misrepresented us now we are in major trouble. Should I get a lawyer. Should the bank not take some responsibility for the way they represented us and got us into this horrible spot that we are in. We did everything according to how they guided us to. Please respond. even with opinions.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
