State: Ontario Hello, I am entertaining the purchase of property that is currently under-going a Phase 1 environmental assessment. Regardless of the outcome of this assessment, I would like to know what conditions I can put into my offer so that I would not be held responsible should future environmental problems arise. Is there such thing? Thanks |

You can ask for an environmental indemnification--ie they will pay you if that happens--and you can hold back part of the purchase price in escrow to cover it as well if they would agree...
