My AOSmith 80 gall.water heater was leaking so I called a local plumber (telling him that I thought the water heater was under warrantee). He said he dealt with AOSmith and would help me with this. I then called AOSmith and found that my water heater was still under warrantee - for two more months. They said all I had to do was give my plumber a copy of my original receipt, with my model and serial numbers on it. I would only be charged for the plumber's labor. I did this and the water heater was installed.
Two weeks later, the plumber called me to say he mistakenly installed the wrong brand water heater. He said WE had a problem and that I could do one of two things. I could 1) keep the water heater he put in and he would charge me $980 or 2) He could take out this water heater, and install the one supplied by AOSmith and he would charge me $490. He said he was adding $149 extra for gas and for paperwork. I talked with several other plumbers, and they say I am being overcharged for his mistake. What can I do? |

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.

Okay, so far I haven't paid anything. I just got a bill from the plumber for $980. Should I have him take out the water heater and put in the warranteed one. He will bill me for $490 then. Should I pay this high fee (it includes his paperwork fee and gas to go get the warranteed water heater- about $149 extra). The problem there is - we have to take another day off from work to be there so he can correct HIS mistake. And then should I file a complaint with the BBB? What can he do if I don't pay his paperwork/gas fee?
