Cool Partition of Property???

I am getting divorced and I know the judge will order the house sold. I will be very happy. In the meantime, I want out now!!!! Can I file a lawsuit for partition of property or partition by sale? Me and my husband are both on the deed. As far as I know we are co-owners. We are in NY. I cannot go on living with him anymore. He is emotionally and mentally abusive.
