In California, I believe that fraud and/or partial performance place a
contract outside the statute of frauds. I need confirmation and legal authorities for this, specifically, I need California Codes and case law that support that the statute of frauds is not a defense to contracts that have been either partially performed or where there was any fraud in the formation of the contract.
