Default unknown

I am an independent salesperson - though am an employee. No pay - just commission. My employer sells products - they offer payment by check or credit card. If the customer uses a credit card, I am made to give up a percentage (approx. 2.5%) of the sale because the client used a credit card.
Is this legal??
