Default Indian law

In Arbitration & Conciliation Act 1996 if any person filed section 34 application then all proceeding stop but section 9 maintainable.Is it draw back of the act?

Which setion say if any person got injunction under section 9 Arbitration & Conciliation Act,1996 then 0rder 39 Rule 3 CPC compliance is not reqiured.
