Our company is leading supplier involved in the distribution of motor vehicles located in Accra the capital city of Ghana, West Africa.
We are seeking the advice of a substantial and competent law firm with a view to issuing actions against Mitsubishi Motors Corporation of Japan (MMC) concerning two issues that have severely damaged our heretofore-successful operations.
Issue 1.
Concerns a situation where MMC supplied circa 200 Pajero type motor vehicles with faulty engines. Shortly after commissioning the engine started burning oil and eventually failed whilst still well within the MMC warranty period.
It was evident from the first discovery of this complaint that the only remedy was the replacement of the engine.
MMC after proscribing a number of useless and futile modifications refused and neglected to attend to this clear manufacturing fault and left us to suffer the consequences.
This included the cost of having to repair as best we could the faulty engines and the fending off of a number of threatened legal actions. Much correspondence was created by this issue which eventually culminated in the Directors traveling to Tokyo to attempt to find a resolution to this problem. During this meeting it was disclosed by an employee of MMC that this was a manufacturing fault (unsuitable piston rings) and that the number of engines involved ran into many thousands. Many promises were made to deliver replacement engine blocks but these promises were not fulfilled.
It was the case that MMC even refused to reimburse us for genuine warranty claims. A rough scope of the amount involved in a proposed action would be circa $US8 million. It was subsequently discovered that MMC were sanctioned by the Japanese Ministry of Transport for not disclosing customer complaints and attending to clear manufacturing faults.
Issue 2.
Concerns the situation where MMC arbitrarily and unilaterally appointed a new distributor in place of us.
This where we (who were the first to import MMC vehicles into Ghana) had served them loyally for twenty-seven years (27yrs) and established the brand as a top seller in the Ghana market. Further that throughout the twenty-seven years we had at the instigation, request and directives of MMC invested substantial infrastructures to promote MMC products inclusive of showrooms, workshops, warehouses, storage yards and an assembly plant.
A rough scope of the amount involved in a proposed action would be circa $US140 million.
The two-abovementioned issues are both likely to evolve into class actions especially issue 1. Where it is known that the distribution of faulty engine Pajeros was in the excess of fifty thousand engines and where it is known that MMC deliberately hid the extent of the problem from their own regulatory authorities.
