Company Broke Lease-to-Own Contract???
I am leasing-to-own a brand new 50in t.v. from Aaron's in Waco, TX. I have been making payments on it for 9 months. The second month we had it, they had to pick it up and send it to the shop to get repaired and brought us a used loaner. The problem with this is that 7 months later, I still don't have my contracted t.v. while I have still been making payment on it. They had just told me last month that it was sitting in the store unfixable and they cannot provide me with the same t.v. because they no longer sale them. I told them that I am no longer making payments for a new t.v. that I do not even have. I asked for their regional office number and they refused to give it to me and told me that they would find me a new t.v. I asked to see my broken t.v. that they said was in the store and they won't or can't show me to prove that it isn't resold in someone else's home. They just keep saying that it is sitting up there, but is still unseen to my eyes. So this month's payment is due, I have been paying new price for a t.v. I still don't have, and obviously won't have, and still have the used loaner that is messed up as well. They keep calling and harrassing me, my family, to pay this month and I haven't had the t.v. that is in our contract for 8 months now. CAN I GET ALL MY MONEY BACK SINCE THEY BROKE OUR CONTRACT AND CANNOT PROVIDE ME WITH THE T.V. THAT IS IN OUR CONTRACT OR EVEN SHOW IT TO ME? I think after all they have done wrong, they should give my money back and owe me a new t.v.??? They have also disscused my account with other people without permission and once they thought my sister was me talking to her husband and told him to tell me to shut up and worry about my own acount and not theirs. What an and should I do about all of this? What can I get out of this?

You can get back any loss or lesser value for the item that you do have at home--the replacement.
Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office. |

RESPONSE FROM GM AARONS BELLMEAD
Original TV. went out about 3 months after they received it. We immediately took customer a loaner TV. identical to one to be repaired. We then took TV to DTS of Waco for repair. After 60+ days repair shop still could not get any parts for TV. We then told customer that there TV. could not be repaired due to parts not available. Told customer that they could keep loaner as there TV. even though it was a newer then the one they had. Customer said ok. A couple of more months went by. Customers payment became non renewed so we had to call them. When we asked about there payment they said that they were not happy with the TV., by this time we could no longer get this TV. anymore. I told customer that I would try to find them another TV. After locating multiple TV's for the customer I could not find or contact them. Customer called me and said they were out of town and they had already mailed payment, at this time customer was 7 days nonrenewed. The customer is now more then 30 days nonrenewed. When spoke with customer couple of days ago customer said still out of town if we have TV's to show him we would have to bring them by his house for his approval when he gets back. Since this conversation I have not been able to reach them. I will continue to leave messages daily trying to resolve issue with customer. P.S. We also have another TV. coming from F092 for possible exchange for customer.
