ive just left my employment by mutual consent after i had ran up quite a a large bill on my company mobile now they refuse to pay me my last months wages and are also looking for the difference from me i just wanted to know where i stood with this before i take it any further. any help would be greatly appreciated and sorry if i posted in the wrong section

South African law states that an employer is not allowed to withold any money due to an employee. The employer has to pay the employee for his hours service to the employer and can only then sue the employee for the money owed to the company (the legal cost to the company won't be worth while). The employer is not even allowed to fire the employee in such a case, without all the necessary steps (which is also very time consuming).
This is a South African perspective. |

They have to pay you and the bill unless your actions were unreasonable and beyond the scope of authority you were given--that is a bit of a fact question but you likely have some idea about whether it was reasonable or not.
