Here I have 5 questions(based on singapore law)
Is the paragraph as a whole true or false? Explain your answer. 1. Implied terms of a contract are always about matters which the two parties to the contract have discussed before signing the contact, but which they have not put into the written contract. A court will only imply a term into a contract if the two parties had discussed it before the agreement but just had not included it into the written contract. 2. Both parties to a contract must comply with all terms of the contract. If one party does not comply with any term, he is said to have "breached" the contract. If one party has breached the contract, the innocent party would always have the right not to perform his own obligations under the contract and would also always have the right to cancel the contract. 3. When you wish to enter into a contrac, you must always make sure that everything in the contract is written down and that you and the other party both sign the contract. If an agreement is written but not signed, it is never valid and neither party has any contractual rights with such an agreement. 4. For a contract to be properly formed there must be a valid acceptance. It is possible to have a valid acceptance even though the person who made the offer does not even know the offeree has accepted trhe offer. 5. If a case is being heard in court, lawyers in the case will tell the judge about previous cases hoping that the judge will follow the decisions in those previous cases. Even though India is not a part Singapore's legal system, there are times when a case from India may be mentioned in a Singapore court by a lawyer. And the Singapore court may even choose to follow the decision made by the court in India. |
