I opened a bank account with Soverign Bank in Decemeber 2010. When i opened it i signed a paper stating that if my account didnt have sufficient funds my debit card could **** go through there would just be a one time charge of $35. I remember clearly asking the lady if it was a one time fee, she said yes. I recently went over and used the card 3 times i used about 30 but now my account is over drawn 130. I called and talked to them they said yeah a one time fee PER TRANSACTION. Im 17 years old can this be voided? and if it can how do i go about i?

Recently legislation was passed requiring banks to require depositors to "opt in" for such overdraft charges against their checking accounts. Apparently you did, not realizing that $35 would be charged for EACH overdraft. A phone call to the bank, followed up by a letter instructing them to cancel the account, or if you prefer, cancel the overdraft charges and opt OUT if you choose to keep the account. Due to your age they will have trouble collecting, anyway. |

Generally law is strict in the case of minors entering into a contract. Law clearly state that minor cannot enter into a contract directly, if they do so the contract will be void. But they can enter into contract with the consent of their parent/ guardian. Banks will always insist for the consent of the guardian in the case of minors opening bank accounts. Anyway you can ask for the bank to waive the charges taken by them for each transaction. Before you do the same just check the bank policy in the case of minor’s opening bank accounts. If you could find out that the bank has acted in violation to the policies then you can directly complain to the Manager of the bank and cancel your account. You can also claim for the amount illegally charged by the bank.

When i opened the bank account my mom was not with me, I was by myself. I called today AGAIN and explained the situation and they keep telling me they will not waive the fees. I have talked to many associates, supervisors, and managers they all tell me the same thing they will not waive the fees no matter my age. I really don't know what to do they keep telling me NO. From here im guessing i have to get my self a lawyer?
