Asking for a copy? Don't have one!

I hope this can help! I had a cell phone and Roger's sent me another one over the mail! They added it on to the original contract that was supposibly signed! I was told I wouldn't spend more than $40.00 a month. It was about $70.00 a month when I received the 1st bill. The accessories that were to be sent with this phone did not materialize. I do not remember sending a signed contract back for the second phone. Due to a job loss, I tried to cancel the phone to no avail! The phones were not used the majority of the time but the bills kept piling. They charged us for 3 months after the supposed contract was up! I requested a copy of the signed contract 2 to 3 times and was rejected. The collection agency contacted me in the mean time and said I refused to pay! I said I would gladly pay if my copy of the contract was sent to me. I am still waiting to see the copy and that was a year ago! I now was sent a draft for small claims court! Do I get a lawyer and what kind of retribution can I get for this if any! Thanks

Based on what you say here, you could file suit against THEM (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
