Default Renters Contract: I am about to give 30 days notice for the military

I am currently renting an apartment. I have had 2 leases, which the first lease expired May 28, 2010 and now the new lease is from May 28, 2010 until my EAD date. I am married and neither my wife or I had ever had a renters history, so my mother co-signed the lease. When I went to sign the current lease in April of this year the apartment had her name on the new one as well, but never had her sign it. I have now been under the new contract for 2 months and they have cashed 2 checks since then under it. They now all of a sudden want my mother to sign the lease. This could be a problem since I am about to give 30 days notice for the military and she will not be on the orders. Can they still make her sign this contract?

I wish to inform you that your mother can be made to sign lease document only with her will. In this regard, signing by you does not make your mother liable. Till the time your mother has not given acceptance she cannot be held liable for new contract as she has not consented. You may give notice of termination of your contract. In this, if the signing of co-signer is necessary then the contract will not be valid till the time co-signer has not signed as this was a condition in the contract. If co-signer is not necessary then contract between you and landlord is valid and may be terminated as per contract.
