Contract written poorly, need advice quickly please!!
Hello,
I am in a bind. a employee of mine (now former) used my company name and license to get "side" jobs. im now in dispute with a contract on remodeling of house. the contract is vague and continuiosly states blah blah will be done "ACCORDING TO PLANS" now the customer is a realitor and im sure shes milking me for trying to honor her contract, she has shown me a set of plans that is very detailed where the contract is vague but I dont beleive its the actual plans the contract is reffering to. Wouldnt the plans be signed too? along with the contract? by all parties? her response when i asked for the plans signed was "do u sign every page in a contract?" but wouldnt plans be like an attachment? also contract says deposit due to begin work, installement due upon completion of framing inspection. well installment was paid in july 06 and the inspection was done on aug 29, 06. Failed horribly i might add, november 2 i was informed of this project and went to straighten things out. my xemployee had completed over half of the contracts requirements plus an additional $37000.00 worth of requested extras!! i want to make things right and redo everything but isnt she responsible for letting him continue working without the framing inspection done? the proposal of contract was 46000.00, requested extras is 37000.00 that was time and materials, not a bid. now everything needs to be removed and replaced. is this 46000 contract gonna cost me 166000.00?? |

The plans normally would be an attachment and would have to be agreed. And they have to be reasonable. She cannot force you to do every last thing she may think of.
