Money Back Guarantee Scheme

1. I have entered into a contract with 100% money back guarantee. But the condition is I have to attend 90% of the course and only seek refund at the end of 1 year.
2. I have requested to withdraw from the program within 13 hours after signing the contract due to family problem.
3. The firm refused to refund due to the term and condition and advised me to continue the program instead of waste my hard earn money.
4. I have filed claimed to the Singapore Small Claim Tribunal for a Hearing. The Your Honour dismissed my case due to the term and condition and mentioned that there is no case until the 1-year time bar.
5. The course started before the Hearing and I have checked with the firm whether I should go for the class first (as I need to attend 90% of the course) in case my claim is not successful.
6. The firm advised me to wait for the outcome and will give me a 1 to 1 session for me for whatever I have missed.
7. After the hearing, I email the firm to arrange for the course and told them that I will attend 90% of the course and wait for the 1-year time bar before request for refund.
8. The firm informed me that I will no longer be eligible for the money back guarantee scheme as I have write to withdraw from the program previously.

Question. Can the firm do that to avoid my claim in 1 year later?

Normally a refund should be granted if the course has not even started. They had no real damages.

But it seems you lost that point in court already--so either attend and then seek your refund, or write it off as bad lesson.
