Need some Help. Civil Case

I was served papers of eviction on Nov, 18 2005, it gave me 3 days to move out. I moved out on the 21st. I am now in the middle of a lawsuit where these people say i should have left all my restaurant equipment behind. (stuff i purchased and installed) All the items were stand alone items. We had no contract in place at the time i was evicted. I had been there for 2 years, my contract terminated, I continued on a month to month rent. I had paid the landlord a deposit of 1350 when I first signed the initial contract. On Novembers rent due date, i told him i would pay him the difference of the deposit and the rent ($250), he said "no" and i needed to pay him 1600, because i never paid him any deposit. Anyways, after a few days of back and forth, we were served papers of eviction. We cleaned up the place and moved all of our stuff out. My attorneys did not file a countersuit on our behalf for time lost from work and the stress that we have gone through. According to them, we are SOL on filing for a countersuit (one that could be heard the same day). Our case has been postponed several times, for about a year now and now scheduled for Jan 12, 2009. My question is, what are my options to countersueing these people? Do i have get a whole new trial and so on? I live in Texas if that matters.
