Angry Gym Membership

My partner signed a 3 year gym membership in Richmond VA and after 6 month's of use, she started a new career. She became a travel Nurse. We contacted the gym about the new job and asked what they needed to cancel the membership. They have no franschise gyms for us to go to.

They said to give a 30 day written notice and to provide a copy of her travel contract. We did so and they still refuse to cancel the membership and every month they take out our dues. We called while in CA, to complain again and they said all we needed to do was show proof that we live in CA. We sent them bills we are paying for CA serivices and a copy of the rent agreement and another copy of the contract assigning her to a CA hospital. Still they refuse to end the membership. We have been gone since March of 2007 now.

The gym owner says that when we return to town, they will let us come to the gym without paying based on the number of months we paid for service not rendered. We told them we are not returning to town. Still they refuse to terminate the contract. Can they do this? Can we get our monthy dues back or can we call our bank and deny them access to our account? We would like to get our money back.

good question: Were headed back home for a vacation and will stop in to get a copy. She didn't save her copy when she joined. We did ask them the procedure and got two different answers. The management staff said all we needed to cancel was a copy of her contract for traveling out of state and something with our new address when we arrived. After, the owner of the establishment said our contract could not be cancelled. That when we return she will comp our time away. Problem is that we are not going to return ever.

Will post contract info when we return at the end of May.
