I am located in Ontario Canada. I was recently charged with possesion of stolen goods for a saw that I had purchased that turned out to be stolen. I was released on a personal recognizance pending trial. I aquired an attorney and signed an agreement with him to appear on my behalf in court. The very next week I was arrested for failure to appear. It turned out my lawyer had neglected to show up and I was arrested and locked in jail for the weekend. The following Monday my lawyer arranged for my release and had the non-appearance charge removed. My questions are
1: Am I able to use this incident as grounds for an appeal should a conviction follow (I am on Legal Aid and am not permitted to change lawyers)? 2: Is there any action that I can take against the attorney involved? |

That will not allow you to change the case normally--
but that is malpractice by the lawyer--he could be sued and a complaint could be filed with the Law Society. He needs to make some kind of amends to you for that...like perhaps a refund while still taking the case. |
