I live in Tennessee. When I bought a franchise day care center, I had an attorney represent me and be present at the closing. To make a long story short, I was screwed by the franchise company and tried to take them to arbitration (this was required). The arbitrator was presented with a document I signed at the closing, which was suppose to transfer the Franchise Agreement from me personally to my LLC. BUT, it contained a provision which released the franchise company from all liability. The franchise company failed to check the TN regulations and the result was that I could only have 1/2 of the number of children that their other centers have. After 19 months, the bank had to repossess the center. I lost everything.
I have tried to find a TN attorney to represent me against the atty. that allowed me to sign this "Trojan Horse" document, but haven't been able to locate one. I need an atty. who will take it on a contingecy basis. HELP!! Rick Holmes |

It may be hard to get those business dispute matters resolved by contingency.
But consider having one or two evaluate your claims and the documents you signed. You may then want to proceed even if you pay for it. |
